Leave to correct the Crime Number in paragraph 1 of the Applicant as Crime No. 85 of 2020 granted. Necessary correction to be carried out within one week. 2.
The Applicant apprehending his arrest in connection with the investigation of Crime No.85 of 2020 registered with Sangli City Police Station, Dist. Sangli under Section 306, 385, 506 read with Section 34 of I.P.C. is seeking pre-arrest bail. 3.
Arun Waghole committed suicide on 01.03.2020 by consuming poison. The allegation is that Pallavi, who is the wife of the deceased and Sejal, who is the daughter of the deceased, were having illicit relations with co-accused Salman. Insofar as Sneha Chavan page 1 of 2
18 aba 2423-21.doc the present Applicant is concerned, it is alleged that he is also having illicit relations with Sejal, the daughter of the deceased and out of the harassment of his wife Pallavi, daughter Sejal, coaccused Salman and the present Applicant, the deceased committed suicide.

The record discloses that co-accused Pallavi and Salman have been granted anticipatory bail by this Court by order dated 13.10.2021 in ABA Nos. 807 of 2021 and 707 of 2020. 5.
The record further discloses that on 07.10.2021, this Court has granted interim protection to the Applicant observing that prima facie no offence under Section 306 of IPC is disclosed qua the present Applicant.

On hearing the learned counsel for the parties, it thus appears that the ingredients of Section 306 of abetment of suicide may not be prima faice made out. The co-accused have already been granted anticipatory bail. In such circumstances, the present application is disposed of by making order dated 07.10.2021 absolute subject to the condition that Applicant shall co-operate with the investigating agency as and when required and shall not tamper with the prosecution evidence or witnesses.
