The learned counsel Mr.Joshi for the appellant states that the matter is compromised before the M.A.C.T., Satara in M.A.C.P. Darkhast No.64 of 2017. A pursis to that effect is passed on vide Exh.13.

Subsequent to the aforesaid, the following order is passed on 11/12/2021.

2/2 8 FA-734-18.doc "The matter is compromised. Pursis to that effect is fled at Exh.13. The amount deposited in the Tribunal be paid to the D.H. after withdrawal of appeal before the Hon'ble High Court. In view of compromise pursis at Exh.13, Darkhast is disposed off."

In the wake of the aforesaid order, the First Appeal is sought to be withdrawn by the Insurance Company. The First Appeal is disposed off as withdrawn.

The appellant is entitled for refund of the court fees as per rules and the Registry shall ensure the same. The statutory deposit which is lying in this Court, shall be remitted to the Tribunal and shall be permitted to be appropriated by the claimants alongwith the interest accrued thereon. 3.

In view of disposal of the First Appeal, pending applications do not survive and stands disposed off. ( SMT. BHARATI DANGRE, J.) M.M.Salgaonkar
