Heard for sometime.

Mr.Sonawane, the learned counsel for the Applicant on instructions seeks leave to withdraw the Petition as the Petitioner intends to surrender in accordance with law laid down by the Supreme Court vide paragraph No.31.1 in Pradeep Ram V/s. State of Jarkhand and Anr1.

The learned counsel for the Applicant submits that upon such surrender the Applicant will apply for bail before the learned Special Court, inter alia on the ground of the subsequent event of the discharge of the co-accused.

In such circumstances, the Writ Petition is disposed of as withdrawn.

Needless to mention that the if Applicant files an Application for bail, after surrender, the learned Special Court shall decide the same on its own merits and in accordance with law.
