DATED : 22nd AUGUST 2022 P.C:- Considering the nature of accusations faced by the applicant, the learned APP Mr.Gavand state that a notice u/s.41A of Cr.P.C was issued to the applicant. In pursuance to the notice, he did not appear.
In the wake of the recent circular issued by the Director General of Police, it is incumbent on the Investigating Officer to issue a notice u/s.41A and strictly abide by the directions issued by the Hon'ble Apex court in case of Arnesh Kumar Vs. State of Bihar (Criminal Appeal No. 1277 of 2014/ (Special Leave Petition (CRL.) No.9127 of 2013) Tilak
2/2 906 ABA 2280-22.doc Since the notice is issued to the applicant, he shall report to the Investigating Officer within a period of three days from today.
The Investigating Officer shall adhere to the procedure prescribed u/s.41A of Cr.P.C, and in case if he is desirous of arresting the applicant, he shall record the reasons u/s.41A and give a notice in advance of 72 hours. With the aforesaid directions, application is disposed off.
