This is an application for bail u/s.439 of Cr.P.C. It is alleged that the applicant has extracted sand of a river and wanted to transport it to someone place. The police have seized a truck in front of the house of the applicant. It was loaded with a sand. The owner of the truck is already released on bail. The case of the prosecution is that the applicant has extracted sand from the river and he wanted to transport it to some place but the truck was seized with sand. 2.

Perused the FIR. It appears that the informant came to know that the applicant had driven the truck. But nobody has seen the driver of the truck. The Aarti Palkar

2/2 12.BA.3532.2021.doc applicant came to be arrested on 14.09.2021. The investigation is almost completed. The owner of the truck is already released on bail. Therefore, no purpose would be served to keep the applicant in custody. Hence, I pass the following order.

ORDER

1. The application is allowed.

2. The applicant is directed to be released on bail in connection with C.R.No.637 of 2021 registered with Shirur Police Station on furnishing PR & SB bond in the sum of Rs.15,000/- with one or two sureties in the like amount. 3.

The applicant is directed to attend the concerned police station trice in a week i.e. Monday and Friday between 9.00 a.m. to 11.00 a.m. for the period of two months.

The applicant is directed not to tamper with the prosecution witnesses. 5.
