1] Applicant is seeking pre-arrest bail in C.R. No. 496/2021 registered with Naya Nagar Police Station for offence punishable under Sections 376, 420, 406, 506 of the Indian Penal Code. 2] Prosecution case against the applicant is, he had established physical relation with the complainant who was working in dance bar and extracted amount of Rs. 20,50,000/- in cash. 1/3

3] It appears that the alleged physical relation under the pretext of marriage are claimed to have been established between 2019 to December 2020, however, complaint is lodged after delayed period of 9 months on 05/09/2021.

4] Apart from above, there is no material on record to infer that complainant at relevant time was having cash of Rs. 20,50,000/- as has been claimed. Applicant himself has lodged the complaint against the complainant through his lawyer alleging threat of extortion. 5] In the aforesaid background, false implication of the applicant cannot be ruled out.

6] In that view of the matter, applicant deserves pre-arrest bail. (i) In the event of arrest of the applicant in C.R. No. 496/2021 registered with Naya Nagar Police Station for offence punishable under Sections 376, 420, 406, 506 of the Indian Penal Code, he be released on bail on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

(ii) Applicant shall neither influence prosecution witnesses in any manner nor tamper with evidence. (iii) Applicant to attend Investigating Officer from 22/11/2021 to 26/11/2021 between 10.00 a.m. to 12.00 noon and thereafter as and when directed 7] Application stands disposed of.
