The applicant by this application is seeking condonation of delay in preferring Revision Application challenging judgment and order convict him for the offence punishable under Section 138 of Negotiable Instruments Act, 1881. It is submitted that the applicant is in custody since 2010, as he was also involved in other cases pertaining to the offence under Section 138 of Negotiable Instruments Act, 1881. Considering the reasons assigned in the application for condonation of delay and the submissions advanced by the counsel for the applicant, the delay is required to be condoned by giving an opportunity to the applicant to decide the matter on merits of the case. In the circumstances, the application seeking condonation of delay is allowed. Criminal Application No.381 of 2018, stands disposed of accordingly.
