By this petition, the petitioner challenges the order dated 31.8.2013 terminating the service of the petitioner after being declared as surplus on the ground that the petitioner had not tendered the option form informing the respondents that the petitioner was ready to work on a post with similar pay-scale.
It appears on hearing the learned counsel for the petitioner that after the impugned order was passed, the petitioner has tendered the option form to the respondents.

3-wp-10866-14 Ms. Bhende, the learned Assistant Government Pleader appearing on behalf of the respondents states that there are 27 vacant posts of junior clerk having similar pay-scales in Pune region and if the petitioner is ready to work on one of the posts, the respondents are ready to accommodate the petitioner on the same. The learned counsel for the petitioner, on instructions from the petitioner, who is present in the Court today, states that the petitioner is ready to work on a post with similar pay-scale in the Pune region. In view of the aforesaid, the writ petition is disposed of with a direction to the respondents to absorb the petitioner in one of the vacant posts as early as possible and positively within a period of three weeks. Order accordingly.
No order as to costs.
