The petitioner raises the issue concerning resolution passed by the Municipal Council, Phaltan dated 28th February, 2014 wherein a resolution was passed, allowing handing over of cultural hall constructed by the Municipal Council to third party for converting it into a Multiplex. The Counsel appearing for the petitioner submits that representation dated 28th January, 2014 has also been made to the Collector under Section 307 and 308 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Township Act, 1965. The petitioner seeks direction to respondent no.1 to take decision on the said letter.

The learned Counsel appearing for the Municipal Council on instructions submits that the subject resolution has not been acted upon by the Council and Council would also take appropriate decision in this regard.
