Heard Mr. Mahesh Rawool, learned counsel for the petitioner and Mr. Nitin Deshpande, learned counsel for the respondents.

By this Petition, the petitioner has challenged the Judgment and order dated 9.9.2004 passed by the learned Jt. Civil Judge, Sr.Dn., Pune below Exhibit-1 in Misc. Application No.8 of 2004. By that order, the learned trial Judge appointed the Trustees for the tenure of five years from the date of the order.

Mr Rawool states that there was no
2 / 2 WP/ 10108/2004 interim order pending the Petition. He has tendered copy of E-mail dated 8.7.2015 which is taken on record and marked 'X' for identification. By that communication, Mr Makarand R.Deo, Chief Trustee of respondent no.2Ranjangaon Ganapati Deostan Trust informed Mr. Shah that Mr. Vasant M.
Deo, petitioner herein, expired on 24.12.2013. He has instructed Mr. Shah to withdraw this Petition.

In view thereof, Mr. Rawool seeks permission to withdraw this Petition. On the motion made by Mr. Rawool, Petition is allowed to be withdrawn. Rule is discharged with no order as to costs.
