Heard. The learned counsel for the Applicant submits that he received instructions from his client to delete the name of Respondent Nos.2 and 3 from the cause title of the Civil Application as well as the Civil Revision Application. Same is permitted. Amendment to be carried out during the course of the day.
By this Civil Application, the Applicant - Defendant No.1 seeks to condone three months delay in filing the Civil Revision Application to challenge the order dated 01.01.2018 passed by the learned 3rd Jt. Civil Judge, Senior Division, Solapur below Exhibit- 91 in Regular Civil Suit No. 223/2011. Basavraj G. Patil 1/2
916.550.18-cac.doc Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.
Hence, the following order:
a) Civil Application is allowed in terms of prayer clause (a) which reads thus:
"(a) The delay of 3 months and 27 days in filing the present Civil Revision Application may kindly be condoned."
b) Amendment as stated hereinabove be carried out. c) Civil application stands disposed off accordingly. (K. K. TATED, J.) Basavraj G. Patil 2/2
