The only relief sought in this petition is to issue directions to the concerned Court to conclude the proceedings in C.C. No.499/PW/2017 and C.C. No.64/DV/2017 expeditiously. 2.
It is submitted that, in the proceedings in C.C. No. 499/PW/2017, the evidence of the prosecution witnesses has been recorded and the case is due for recording statement of accused under Section 313 of Cr.P.C. whereas the proceedings in C.C. No. 64/DV/2017, the recording of evidence is concluded and the proceedings are due for delivering the judgment. The Petitioner is the NRI and presently residing at U.K.

Learned APP on instructions from the officer present in the Court submits that, in the proceedings arising out of C.C. by SAJAKALI LIYAKAT JAMADAR Date:

20-WP-3853-2021.doc No.499/PW/2017, the evidence of the prosecution witnesses is indeed concluded and the case is at the stage of recording of statement under Section 313 of Cr.P.C.

Considering the aforesaid circumstances, the proceedings can be expedited. No prejudice would be caused to either side.
ORDER
i.
Learned Metropolitan Magistrate, 34th Court, Vikhroli, Mumbai is requested to conclude the proceedings in C.C. No.499/PW/2017 and C.C. No.64/DV/2017 within a period of two months from the date of receipt of this order. ii.
This order shall be communicated to the trial Court by the Petitioner.
Iii.
Writ Petition No.3853 of 2021 is disposed of accordingly.
