This Civil Application seeks condonation of delay in order to challenge the Judgment and Award dated 6.1.1997. The matter is pending since the year 1997, basically because no diligent steps were taken to serve the Respondent. The delay in institution of the appeal was 175 days as per the application filed. The Registry has, however, stated that the delay is of 27 days. Even today, service upon the Respondent is not completed. Pg 1 of 2

13.ca.1755.2000.doc The entire compensation amount involved in this case is Rs.4,070/-. There is no point in proceeding with the matter any further. Accordingly, for the reasons set out in the order dated 6 February, 2017 in Civil Application No.5080 of 2001 in First Appeal (ST) No.1251 of 1999, the Civil Applications as well as this Appeal are hereby dismissed. The interim order, if any, is hereby vacated. This dismissal order by itself should not be taken as an approval of the rate awarded by the Reference Court.
