By this Civil Application, the Applicant is seeking condonation of 238 days delay in filing the First Appeal challenging the Judgment and Award dated 05.08.2017 passed by Motor Accident Claim Tribunal, Mumbai in Application No. 808 of 2011.

Learned Counsel for the Applicant submits that before filing any Appeal in the High Court, they have to take decision on several levels. She submits that in that process, there is delay in filing Appeal. 4.

Considering the submissions made by learned Counsel for Applicant and averments made in Civil Application, I am satisfied that the Applicant has made out case for allowing this Civil Application. Hence, following order :

(i) Delay of 238 days in filing the First Appeal is condoned. (ii) The Civil Application stands disposed of accordingly. No order as to costs.
