IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO. 3171 OF 2017 Govind Kabra Bhadricha and Ors.
... Petitioners V/s.
The State of Maharashtra and Ors.
... Respondents ---------------- Mr. R.J. Baddani I/b Rajesh Dubey for the Petitioner. Mr. K.V. Saste, APP for Respondent State.
Mr. Jaydev Trivedi a/w Bhupali Vaze for the Respondent No.3. ---------------- CORAM : B.P.DHARMADHIKARI, & REVATI MOHITE DERE, JJ.
DATE : 06th FEBRUARY, 2019 P.C.:
1.
Heard learned Counsel for parties. Perused report, receipts and also the report submitted by learned APP. 2.
Learned Counsel for the Petitioners states that tenement to be transferred as per report and documents is 18/A and the investigation has been in relation to 18.
3.
We have perused papers. The statement dated 20.04.2017 of first informant (Respondent No.3) clearly mentions 18/A. Receipts to which our attention is invited by Petitioners also show that amount is received towards agreed price for creating tenancy in respect of Room No. 18/A.
4.
We, therefore, wanted Petitioners to demonstrate from their Sneha Chavan 1/2
4 wp 3171-17=.doc pleadings that Tenement No.18 and 18/A are distinct. There is no such effort. Petition does not contain any such assertion. 5.
We are, therefore, not inclined to intervene in extra ordinary jurisdiction. Writ Petition is rejected. No costs. (REVATI MOHITE DERE, J.) (B.P.DHARMADHIKARI, J.) Sneha Chavan 2/2
