The applicant is arrested on 3rd October, 2020 in connection with C.R. No. 1050 of 2020 registered with Bharti Vidyapeeth, Pune Police Station for the offence under Sections 302 and 201 r/w 34 of Indian Penal Code.

The prosecution case is that on 29th September, 2020 police constable Ajit Kokre was on duty. At about 7:20 a.m. he received information from PSI Dighe that the person by name Sandeep Haridas Gopane called the police and informed that dead body is lying opposite Lekeshrushti lodge on service road of Pune-Satara. Accordingly first information report was registered. During the course of investigation it was revealed that Rohidas Patole had killed deceased with the help of co-accused Kunal Patole, Pravin Shinde and Omkar Sarke and the body was thrown opposite the
side of Lekshrushti lodge.

The investigation is completed and the charge-sheet has been filed. The case is based on circumstantial evidence. There is no eye witness. The other accused were granted bail by this Court. 4.
There is no circumstance to show that the involvement of the applicant. The prosecution is relying upon the statement made by the applicant/accused showing the spot of incident and place where the victim was killed. That itself is strong no evidence to show his involvement in the crime. Hence bail can be granted.
ORDER
i.
Criminal Bail Application No. 2392 of 2022 is allowed; ii.
The applicant is directed to be released on bail in connection with C.R. No. 1050 of 2020 registered with Bharti Vidyapeeth, Pune Police Station on executing P.R. Bond in the sum of Rs.20,000/- with one or more sureties in the like amount;
iii.
The applicant is permitted to furnish cash bail in the sum of Rs.20,000/- for a period of eight weeks in lieu of surety.
iv.
The applicant shall report concerned Police Station
once in a month on first Saturday of the month between 11:00 a.m. to 1:00 p.m. till further order;
v.
Application stands disposed off.
