The accusation faced by the applicant in C.R.No.864 of 2022 is, he manipulated the date on the license, when his licence had expired and changed it from 24/05/2022 to 23/06/2022, which has resulted in loss to the State Exchequer to the tune of Rs.20,000/-. The applicant also face an accusation that he has produced a forged licence and, therefore, Section 420 is invoked.

The applicant may take the consequence of the said accusation at the time of trial, but at present, the loss attributed by the complainant is only to the tune of Rs.20,000/-. Since the applicant was running a bar and veg hotel and engaged in supplying liquor, but on account of the date being refected as 23/06/2022, he is responsible for payment of license fee from 24/05/2022. Learned counsel for the applicant states that he shall make over the said payment to the State Excise Department within a period of 7 days from today.
For the purpose of investigating, whether there is a forgery in the license produced, no custodial interrogation is necessary, provided that the applicant shall render his cooperation in the investigation. : ORDER :
(a) Application is allowed.
(b) In the event of arrest in connection with C.R.No.864 of 2022 registered with Santacruz Police Station, applicant-Shrey Vishal Karia shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.
3/3 16 ABA-2285-22.doc (c) The applicant shall report to the concerned police station on 6th & 7th October, 2022 at 3.00 p.m. and, thereafter, as and when called for.
(d) The applicant shall deposit a sum of Rs.20,000/- with the complainant i.e. Senior Police Inspector, State Excise, Kandivali, Mumbai within a period of 7 (seven) days from today.
(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with evidence.
