Heard Mr.Sunny Punamiya, learned counsel for the petitioner and Mr. K.K.Kandekar, learned counsel for respondent no.2.

Matter was heard on 17.4.2017. In the order it was recorded that Mr. Kandekar has given notice of production to the learned counsel for the petitioner. None appeared for the petitioner. It was further recorded that Writ Petition (L) No.1374 of 2016 instituted on the Original Side of this Court raising identical controversy as raised in this petition was rejected by order dated 25.5.2016. As none appeared for the petitioner, it was adjourned till today, i.e. 2.5.2017, under the caption 'for dismissal'.

Today again, learned counsel for the petitioner seeks time on the ground that he wants to cite Apex Court judgment. It is

2 / 2 WP/9878/2016 not possible to accede to this request as the matter is kept today under caption 'for dismissal'. Learned counsel for the petitioner did not proceed to argue the matter. Hence, Petition is dismissed in default. Order accordingly.
