The Petitioner's grievance is that though Municipal Corporation has filed a complaint addressed to the Senior Police Inspector, Juhu Police Station, the Police had not registered an offence. The Petitioner is a society who claims to be the owner and possessor of the subject land which was developed by Respondent no.8 developer.

In the facts, we find that it is for the Municipal Corporation having locus to pursue its complaint. In case Petitioner desires, it may independently resort to appropriate remedies. With these observations, the petition stands disposed of. (PRAKASH D. NAIK, J.) (NARESH H. PATIL, J.) MST
