This is an application under Section 439 of Cr.P.C. for bail in C.R. No. 170 of 2017 dated 10.05.2017 registered with Phaltan Police Station, District Satara under Section 370(1)(2) of the Indian Penal Code and Sections 4 and 5 of the Prevention of Immoral Traffic Act.
It is the prosecution case that, the Applicant is the Manager of Amruta Lodge at village Zirapwadi, Taluka Phaltan, District Satara. After a specific information received by the police that the vocation of prostitution was being conducted at the said lodge, the police conducted raid on 09.05.2017 at the said place. The police found two victim womens who were indulging in the vocation of prostitution. The police therefore, arrested the owner of the said lodge, namely, Sharad Gunjavate, the Manager i.e. the Applicant herein and Laxman Sneha Chavan 1/2
41 ba 1880-17=.doc Dalvi, waiter of the said lodge. After completion of investigation, the police have submitted charge-sheet.
The record indicates that the owner of the lodge namely Sharad Gunjavate and waiter Laxman Dalvi have been released on bail by the Trial Court. It is to be noted here that victim women were aged about 33 years and 23 years respectively and in their statements they have stated that they were indulging in the said vocation voluntarily.
In view of the above, the Applicant can be released on bail. Hence, the following order:
i) The applicant be released on bail in C.R. No. 170 of 2017 dated 10.05.2017 registered with Phaltan Police Station, District Satara on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.
ii) The applicant shall also attend all dates before the Trial Court. iii) Any two consecutive defaults in complying with the aforesaid conditions, shall attract the provisions of cancellation of bail. iv) The Applicant shall not tamper with the evidence and/or pressurize or threaten the prosecution witnesses.
