By a separate order passed today in IA No. 1734 of 2013, the present appeal is restored to file.

The appeal memo shows that valuation of the present appeal is Rs.50 lakhs and as such, as of today, under Section 28C of the Maharashtra Civil Courts Act, 2015, the valuation of the present appeal being not exceeding Rs.1 crore, shall stand transferred to the concerned District Court. After the necessary amendments are carried out as ordered by this Court today in IA (ST) No. 30657 of 2022, the office is directed to transfer this appeal to the concerned District Court as expeditiously as possible.

It is clarified that the parties are at liberty to rely upon the paper book which is filed in this Court. Considering the fact that this is an old first appeal of 2004 and the suit involved, is of the year 1991, the concerned District Court is requested to take up the hearing of this appeal as expeditiously as possible, preferably within a period of 1 year from today.

Both the parties agreed that they will appear before the concerned District Court on 08.01.2024.
