The Applicant is one of the accused who is facing trial in Sessions Case No.304/2018 pending on the file of Sessions Court, Pune for offences punishable under sections 143, 144, 147, 148, 149, 120(B), 212, 302 of the Indian Penal Code and section 4(25) of the Arms Act and Section 7 of the Criminal Law Amendment Act registered with Hadapsar Police Station, Dist. Pune.

The case of the prosecution is that on 28/01/2018, at about 14:50 hours, the Applicant and others assaulted the deceased - Sujeet Varma by means of sharp weapons. Said Sujeet Varama was taken to the hospital but was declared dead. The post mortem report reveals that the deceased had sustained 52 injuries in the nature of chop 1/2

P.H. Jayani 27 BA3542.2021.doc wounds, incised wounds on the head and other parts of the body. The death was due to multiple injuries. The post mortem report prima facie reveals that the murder was brutal. The statement of the eye witness - Balaji Bansode reveals that the Applicant was involved in committing the crime.

Considering the nature of the accusations against the Applicant as well as the material in support thereof, in my considered view, the Applicant is not entitled for bail.
