Having heard the applicant's Advocate, we do not proceed to dismiss this Application for want of prosecution. This Application was listed on the earlier occasion, but since both, the applicant and the Advocate, were absent, we placed it for dismissal today. 2.

It is only because of the request of the applicant's Advocate and his oral apology that we do not dismiss this application for want of prosecution. After hearing the applicant's Advocate on the point of admission, we expressed our disinclination to interfere with the ongoing investigation or to quash the First Information Report. When such a view was expressed, leave was sought to withdraw this Application with liberty to adopt the appropriate proceedings. We dismiss this Criminal Application with liberty as prayed for.
