The previous application for suspension of sentence made by the applicant / appellant was rejected by this court. However, it was on 19th July, 2012. Now the prayer for suspension of sentence is renewed on the ground that, quite sometime has avk 1/2

3-APPA-1363-2012 passed since then, but the appeal has not yet been heard. It is submitted that the applicant would be completing actual imprisonment for a period of about 4 years, by June 2015. Under the circumstances, it is directed that the appeal be peremptorily fixed for "Final Hearing'on 12th March, 2015. In view of this, the learned counsel for the applicant does not wish to press the present application. The same is allowed to be withdrawn and stands dismissed as such. Liberty to the applicant to apply afresh for suspension of sentence, in the event of the appeal not being taken up for 'Final Hearing', for whatever reason, by 30th April, 2015. (ABHAY M.
