By consent of the parties, the impugned order dated 14th March 2013 passed by the Industrial Court, Solapur in complaint (ULP) No.51 of 2008 is set aside. The complaint (ULP) No.51 of 2008 is restored to file and to be heard de novo by the Industrial Court in accordance with law and on its own merits. It is made clear that the Industrial Court shall decide the matter afresh without being influenced by the observations and conclusions drawn by the Industrial Court in the impugned order dated 14th March 2013. All the contentions of both the parties are kept open.

If any application is made by the parties for production of additional documents and evidence, such application shall be considered by the Industrial Court on its own merits. This Court has not expressed any views on merits of the matter. The Industrial Court shall make an endeavour to dispose of the complaint (ULP) No.51 of 2008 expeditiously. Writ petition is disposed of in aforesaid terms. No order as to costs.
