By this Civil Application, Applicant is seeking to set aside the order dated 21.06.2018 passed by learned Registrar (Judicial-II) by which Family Court Appeal stands dismissed for non-removal of office objections.

The learned counsel for the Applicant submits that Applicant is ready and willing to remove all office objections within one week from today.

Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and as Applicant is ready and willing to remove all office objections, we are satisfied that the Applicant has made out a case for allowing the present Civil Application.

The learned counsel for the Applicant submits that Applicant is ready and willing to pay cost of Rs.5,000/-. Considering these facts, following order is passed: a) Order dated 21.06.2018 passed by learned Registrar (Judicial-II) is set aside.

b) Family Court Appeal No.163 of 2017 is restored on file. c) Applicant to remove all office objections on or before 20.12.2018, failing which the Civil Application shall stand dismissed without further reference to the court. d) If all office objections are removed within stipulated time as stated hereinabove, Registry is directed to issue notice to the Respondent in Family Court Appeal No.163 of 2017. e) Applicant to pay cost of Rs.5,000/-. Cost to be deposited in the Registry of this court on or before 20.12.2018, failing which the Civil Application shall stand dismissed without further reference to the court.

f) Respondent wife is entitled to withdraw the cost without furnishing any surety.
