Considering the submissions made by the learned counsel for the Applicant and the averments made in Civil Application, I am satisfied that Applicant has made out a case for allowing the Civil Application. Hence, following order is passed a.

Hearing of First Appeal No.808 of 2009 is expedited in the list of Senior Citizen.

Registry is directed to place First Appeal No.808 of 2009 on board for final hearing in weekly board as per its turn in the list of Senior Citizen.

Civil Application stands disposed of accordingly.
