Revision arising out of proceedings under Section 138 of Negotiable Instruments Act, 1988 made in the accused has been convicted. During pendency of revision, the complainant and the accused have mutually resolved their dispute as the accused has paid the amount of cheque to the complainant. The complainant, therefore, agrees that the conviction and sentence imposed on the accused be set aside. Hence, the following order is passed:-

Tauseef Farooqui 08-IA.17.2022.doc (i).The impugned Judgment and order 25th September 2018 passed by the learned Additional Sessions Judge, Kolhapur in Criminal Appeal No.206 of 2008 and Judgment and Order dated 29th November 2011 passed by Judicial Magistrate, First Class, Kagal Court in Criminal Case No.564 of 2008 are quashed and set aside.

(ii). Consent Terms are taken on record and marked "X" for identification.
