The dispute in the above Petition relates to the mutation entry No.36 in respect of the land bearing Gat No.444 and 445 of village Bhagoli, Taluka Chandgad, District Kolhapur. It seems that the Petitioner has filed a Civil Suit being Regular Civil Suit No.40 of 2008 claiming right to the said lands on the basis of title. It is therefore in the said suit that the rights of the parties would be decided. It is therefore not necessary to interdict with the mutation entry in the above Writ Petition. By issuing the clarification that the said mutation entry would be subject to the decision of Regular Civil Suit No.40 of 2008, the above Writ Petition is disposed of. [R.M. SAVANT, J] BGP.
