Applicant is seeking enlargement on bail in Crime No. 89 of 2018 registered with the Dongri Police Station for the offence punishable under Section 489(B), 489(C) of Indian Penal Code. One Hundred Thirty One (131) counterfeit currency notes were found recovered from the house of the applicant in the presence of independent witness. SSK 1/2

The applicant disputes and contends the house where from the counterfeit currency notes were allegedly recovered, neither belongs to him nor was in his possession.

Be that as it may, the cause title of the application shows the same address where from the counterfeit currency notes were seized. In fact, address disclosed in arrest Panchanama and address in clause title is the same. It belies his contention. Besides affidavit filed by the prosecution shows subject offence has been committed while he was released on bail in C.R. No. 160 of 2016.

Learned counsel for the applicant submits the facts alleged against the applicant do not constitute and make out an offence under Section 489B. Reliance is placed on order of this Court passed in application No. 1293 of 2018.
