The applicant is accused of committing an offence punishable under Section 3 of the Maharashtra Prevention and Eradication of Human Sacrifce and other Inhuman, Evil and Aghori Practices and Black Magic Act, 2013. The offence is punishable with an imprisonment, which shall not be less than six months, but which may extend to seven years and with fne.

2/2 914 ABA-2311-22.doc Considering the nature of crime, notice under Section 41A of Cr.P.C. was issued to the applicant on 08/05/2022 and it is the submission of the learned counsel for the applicant that he has abided by the said notice and reported to the police station.

Let the Investigating Offcer follow the procedure prescribed under the said provision and if at all , he is desirous of arresting the applicant, he shall record his reasons in writing and give an advance notice of 48 hours before arresting the applicant.

The application stands disposed off.
