The present contempt petition is fled on a premise that the respondent has fouted the order passed by the Family Court dated 21st March, 2018. The contempt petitioner pray for the heavy costs to be saddled on the respondent for disobedience of the order.

The order of which the disobedience has been alleged is passed in March, 2018 and pertains to the custody of the minor child. Several orders have been subsequently passed in relation to the custody and, therefore, the breach as alleged of an interim order need not be looked into the contempt proceedings, M.M.Salgaonkar

5.1-CP-428-19.doc particularly when Contempt Petition No.432 of 2019 has been disposed of by this Court today. Nothing survives in the Contempt Petition and stands disposed of accordingly.

In the light of the order passed in Contempt Petition, nothing survives in the Interim Application No.1 of 2019 and it stands disposed of accordingly.
