By this application, the applicant has sought to condone the delay of 58 days in filing the first appeal. The learned Counsel for the respondent nos. 1 to 4 has no objection. The respondent no.5 is not present despite due service. In view of the no objection given by the learned Counsel for the respondent nos.1 to 4 as well as considering the reasons stated in para nos.3 and 4 of the application, delay in filing the first appeal is condoned.
