Heard learned counsel for the Applicant, learned APP for the Respondent No.1 - State and the learned counsel for the Respondent No.2.

By this Application, the Applicant seeks the following prayer :- "(a) The Applicant be granted permission to travel to Vancouver, Canada, SanFransisco USA from 31st August, 2016 to

10th September, 2016 to attend Global Business Consortium of London School of Business and 15th to 17th September, 2016 to DP World Sokhna, Egypt."

Learned counsel for the Applicant states that the Applicant is the CEO & Director with D.P.World, Navasheva, Mumbai. She states that the Applicant is required to travel abroad for business purpose to Vancouver(Canada) and San Fransisco (USA) for attending Global Business Consortium of London School of Business from 31.08.2016 to 10.09.2016 and thereafter, from 15.09.2016 to 17.09.2016 to DP World Sokhna, Egypt. She submits that the Applicant's family resides in Mumbai and that the Applicant has two daughters; one studying in 11th Std. and the other studying in 9th Std. and therefore, the possibility of the Applicant absconding is ruled out.

Learned counsel for the Respondent No.2

vehemently opposes the Application. She submits that the allegations against the Applicant are serious and the possibility of the Applicant returning back to India is doubtful.

Learned APP submits that the Applicant be permitted to travel after giving an undertaking to this Court that he will return to India on the 17/18.09.2016. She submits that the Applicant should also give a copy of the undertaking alongwith a copy of his itinerary, containing details of the places where he intends to travel alongwith the addresses and mobile/phone numbers, where he would be residing.

Perused the papers. It appears that the Applicant is required to travel abroad for business purpose. The Applicant and his family are residents of Mumbai.

Considering the aforesaid, the Application is allowed in terms of prayer clause (a). The Applicant shall file an undertaking in this Court that he will return to India on 17/18.09.2016. The Applicant shall furnish his travel itinerary to the concerned/incharge Senior Police Inspector, C.B.D. Belapur Police Station, Navi Mumbai, containing details of the places he will be staying i.e. addresses and telephone numbers, alongwith a copy of the undertaking filed by the Applicant in this Court.
