The order passed by the Joint Registrar in exercise of powers under Section 154 of the Maharashtra Co-operative Societies Act, 1960 thereby remanding matter back to the Assistant Registrar is subject matter of challenge.

The learned counsel for respondent on instructions submits that pursuant to order of remand which is impugned in this petition,

2 28.2227.17 wp.doc the Assistant Registrar has already decided the proceedings and that being so, present petition has rendered infructuous. The submissions made by the learned counsel for the respondent on instructions are accepted. Petition as such stands disposed of as infructuous with liberty to the aggrieved party to take out appropriate proceedings as against the order of Registrar granting or refusing the recovery as was prayed. Needless to clarity that this Court has not examined the merits.
