The appellant-applicant has preferred Interim Application No.3425 of 2021 through jail seeking withdrawal of appeal. In view of the prayer made in the application, the Superintendent of Jail was requested to record statement of appellant and forward the said statement to this Court.

The Superintendent of Kolhapur Central Prison, Kalamba has submitted letter dated 22nd February 2022 to the registry of this MANISH SURESH THATTE MANISH SURESH THATTE Date: 2022.02.26 16:15:23 +0530 Court. The photocopy of the said letter is placed on record by learned APP. The letter states that the appellant-applicant has been released from jail on 22nd September 2021 after completion of his

2 of 2 30.APEAL.1179.2018.doc sentence from prison and he is no longer in the custody. The letter is taken on record and marked "X" for identification. 4.

In view of aforesaid circumstances, the Interim Application Nos.3425 of 2021 is allowed and disposed of. Criminal Appeal No.1179 of 2018 stands disposed of. In view of disposal of Criminal Appeal, Criminal Application No.1258 of 2018 does not survive and stands disposed of as such.
