Prima-facie, case may fall within the Exception 4 to Section 300 of the Indian Penal Code, 1860. Evidence on record shows, crime was without pre-mediation and outcome of the sudden quarrel. It is alleged that the applicant in the heat of passion, assaulted brother on his head by wooden stick/log. Mother of the deceased and the applicant is the complainant, who is eye witness. 11-BA-21172019.odt In view of the evidence, if the trial does not commence on or before 30th June, 2020, applicant may renew his request for enlargement on bail. It may be stated that the applicant is in custody since 13th October, 2017. With these observations, application is rejected. It is made clear that observations made hereinabove be construed as expression of opinion only for the purpose of refusal of bail and the same shall not in any way infuence the trial in other proceedings.
