The applicant was permitted in the past to depart from India on certain conditions and he has complied with those conditions.

In the ordinary course, the appeal is not likely to be taken up for final hearing during the period in which the applicant would be abroad.
The application is allowed in terms of Prayer clause (a) on the following conditions :
i) The applicant shall keep the title documents i.e. Share Certificate and registered Conveyance of his flat in the Highway Co-operative Housing Society Limited, Shiv Shrushti, Kurla(E), Mumbai, with the Registry as a security for his coming back to India.
ii) He shall give atleast 72 hours previous notice in writing to the investigating agency giving the details of his proposed journey, such as :- Ticket number, Flight number, Visa particulars, etc.
iii)The applicant shall give the details of the address where he would be staying while abroad, and shall also give the contact telephone numbers on which he could be contacted while abroad.

iv) The applicant shall return to India by 9th December 2015, and report compliance by remaining present before this court within a week thereafter.
