Though Respondents are duly served, no one appeared on behalf of them when the matter was called out.
By this Civil Application, Applicant is seeking condonation of 57 days delay in filing First Appeal challenging the judgment and award dated 27.3.2014 passed by MACT, Sindhudurg, Oros in MACP No.59 of 2010 holding that Respondent original Claimants are Mohite 1/2
13 ca1280-15.doc entitled sum of Rs.3,86,000 by way of compensation with 8% interest p.a.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:
A) Civil Application is allowed in terms of prayer clause (a) which reads thus:
"(a) The Appellant prays that there has been a delay of 57 days in filing the present First Appeal be condoned by the Hon'ble Court on such terms and conditions as deem fit and proper."
B) Civil application stands disposed off accordingly.
