Heard the learned counsel for the petitioner. By filing this writ petition under Article 226 of the Constitution of India, in substance the petitioner is seeking execution of the decree dated 23rd November 2005 passed by the Civil Court at Dadra and Nagar Haveli.

It is pointed out that notwithstanding the appointment of Surveyor for execution of the Decree for possession, the decree is not being executed.

It is for the petitioner to file appropriate application in that behalf

wp10330 seeking appropriate directions from the Executing Court.

Only if the application made by the petitioner is rejected by the Executing Court or the Executing Court denies the relief, the petitioner can always seek appropriate relief in accordance with law.

Subject to what is observed above, writ petition is disposed of.
