CORAM : A.M.BADAR J.

DATED : 11st SEPTEMBER 2018.

P.C. :

This is an application filed by the applicant/accused for permission to apply for passport.

Heard the learned Counsel appearing for the applicant as well as the learned Counsel appearing for respondent No.2 Regional Passport Office. The learned Additional Public Prosecutor appears for the respondent/State.

Gaikwad RD 1/2

(17)APPANo.12622018 The applicant/accused is convicted of offences punishable under Sections 7 and 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988. The appeal filed by him is already admitted for final hearing and the applicant is also enlarged on bail.

The applicant wants to apply for passport. The applicant was a public servant working as the Police Inspector. Hence, I see no impediment in granting permission to apply for passport particularly in the light of statement of the learned Advocate for the applicant that as and when the applicant would intend to go aboard, he will seek prior permission of this Court. In this view of the matter, the applicant is permitted to apply for passport. However, it is clarified that the applicant shall obtain necessary permission of this Court for visiting the foreign countries.

The application is accordingly disposed of.

Parties to act on authenticated copy of this Order. (A.M.BADAR J.) Raju Dattatraya Gaikwad Gaikwad RD 2/2 Raju Dattatraya Gaikwad Date: 2018.09.11 16:15:49 +0530
