1) The learned APP at the outset submits that in fact the trial has commenced and the prosecution has examined as many as 4 witnesses. 2) In view of this, the court is not inclined to consider the application under section 439 of the Code of Criminal Procedure, 1973 in the midst of trial. Taking this aspect into consideration, the learned counsel for the applicant seeks liberty to withdraw the application. 3) Liberty as prayed for is granted in the interest of justice. Application stands dismissed as withdrawn.
