The Applicant has filed this application for interim bail on medical grounds. The Applicant was arrested in C.R. No.I-394 of 2020 registered with Ambernath Police Station, District-Thane, for offences punishable under Sections 143, 147, 148, 149, 188, 269, 270, 307, 324, 326, 504 and 506(2) of the IPC, Section 51-B of Pandemic Management Act, Section 11 of the Maharashtra Covid Rules Section 11 Sections 37(1) and 135 of the Bombay Police Act.

completed and charge sheet has been filed and the Sessions Case No.59 of 2021 is pending before the learned Additional Sessions Judge, Kalyan. 3.

Learned counsel for the Applicant states that the Applicant is suffering from renal infection and other illness. The medical report was called for. The report submitted by the Medical Officer, Kalyan District Prison indicates that the Applicant is diagnosed with ' right Hemiparesis with stroke'. He had also complained of burning Micturition (urination) and that he has been treated at J.J. Hospital by Urologist. It is stated that he is sufferring from Bilateral grade IV Varicocele, Epididymitis and Minimal Hydrocele. Learned counsel for the Applicant states that the Applicant had earlier taken treatment from Dr. Usha Maheshwari, Ashwini Multi Speciality Hospital. He submits that the Applicant wants to get herself admitted in the said hospital and consult Dr. Hardik Shah, Urologist.

Considering the health condition of the Applicant, he is released on temporary bail for a period of one month so as to enable him to take treatment in private hospital viz. Ashwini Multispeciality Hospital. Hence, the following order:- (i) The Applicant is ordered to be released on bail for a 2/3

period of one month on furnishing PR bonds in the sum of Rs.30,000/- with one or two sureties to the like amount;

(ii)The Applicant shall get himself admitted in Ashwini Multi Spcl. hospital within two days from the date of his release on bail.

(iii)The Applicant shall inform the Investigating Officer the date of admission and date of discharge from the Hospital.

(iv)The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.

(v) The Applicant shall not interfere with the witnesses and /or tamper with the evidence in any manner. 5.

Interim application stands disposed of.
