The Applicant, apprehending arrest, in connection with investigation of Crime No.687/2021 of Police Station Akluj, District Solapur (Rural), under Section 283, 332, 353, 504 and 506 of IPC, is seeking anticipatory bail.

The aforesaid crime is registered on the basis of the complaint lodged by Yashodeep Sadashiv Bhagat. The Applicant is working as a driver with the Maharashtra State Board Transport Corporation. On 31 August 2021, the Applicant was on duty on a bus from Mamta Kale page 1 of 3

Hyderabad to Akluj. The bus reached at Sadubhau Chowk at Akluj at 19.00 hours in front of Satkar Hotel where the Applicant had parked his red black colour Bullet motorcycle in the midst of the road. The Complainant had sounded horn. It is said that some altercation ensued after which the Applicant pulled the informant out of the driver's cabin and assaulted him with slaps and threatened and abused him.

I have heard the learned counsel for the parties. Perused record.

The record discloses that on 29 October 2021, interim protection was granted to the Applicant which is operating. Upon hearing the learned counsel for the parties and having regard to the nature of the allegations, I find that the custodial interrogation of the Applicant may not be warranted.

In the result, the following order is passed.

ORDER

(i) In the event of his arrest, in connection with investigation of Crime No.687/2021 of Police Station Akluj, District Solapur (Rural), the Applicant Anand Vitthal More be released on bail on executing a P.R. Mamta Kale page 2 of 3

Bond in the sum of Rs.20,000/- with one or two solvent sureties, in the like amount.

(ii) The Applicant shall report to the Investigating Officer as and when required and shall cooperate with the Investigating Agency.

(iii) The Criminal Application is disposed of, in the aforesaid terms.
