Learned APP states on instructions of the Investigating Officer, who is present in Court that only 7 witnesses are left to be examined in the said case. Learned APP on instructions assures that the prosecution will make available all the 7 witnesses before the Court to enable the Court to conclude the recording of the evidence of the said 7 witnesses within one month from today. Statement accepted. 2.
On 29th March, 2019, one witness was examined and it appears that the second witness could not be examined as the prosecution was unable
2/2 1-ba.1908.2018.doc to produce the said witness due to connectivity problem relating to the video conferencing. The accused are in custody since 2014. 22 witnesses have been examined till date and 7 witnesses are left to be examined. The Prosecution shall produce all the 7 witnesses for examination before the trial Court on the dates given by the trial Court.

Considering that only 7 witnesses are left to be examined, the application for bail is not been considered.

The learned Sessions Judge to conclude the trial as expeditiously as possible and in any event within 3 months from the date of receipt of this order. If the said trial does not conclude within the aforesaid period, for no fault of the Applicant, the Applicant is at liberty to file a fresh application, which will be decided on its own merits. 5.
Accordingly, the Application is disposed of with the aforesaid direction.
