Heard Shri Sanjeev Sawant, the learned counsel for the applicant / appellant. Heard Smt.P.P.Bhosale, the learned APP. The learned APP points out that the application for suspension of the substantive sentence has already been rejected once by an order dated 5th October 2015. The learned counsel for the applicant / appellant submits that under the circumstances, he avk 1/3

would not press the present application, so far as the suspension of substantive sentence is concerned, but would pray that the hearing of the appeal be expedited.

After considering all the relevant aspects of the matter, I am inclined to direct the appeal to be expeditiously heard. The application is allowed to be withdrawn and stands disposed of as such. However, the hearing of the appeal is expedited.

The appeal be listed for Final Hearing peremptorily. Registrar shall ascertain, in the meantime, as to whether the co-accused who have been convicted on the same trial, have preferred any appeal, and if that be so, those appeals be listed on board on that date, along with this appeal.
