Date : October 4, 2016.
P. C. :
1.
At the outset, Mr. Sutar, learned Counsel appearing for the Petitioner seeks leave to amend the prayer clause (b). Leave granted. Necessary amendment be carried out forthwith. 2.
Learned Counsel appearing for the Petitioner at the outset makes a statement that he is restraining this writ petition to the relief claimed in prayer clause (b). By the said prayer clause, the Petitioner has sought direction to Respondent No.3 to decide his application dated 10th May 2013 seeking permission for development of land bearing Gat No.240 admeasuring 0.27.5 gunthas situated within Kurundwad municipal council limits.
3.
Considering the limited prayer made by the Petitioner, which is very innocuous, we dispense with the presence of Respondent patilsr 1 / 2
No. 3. In the circumstances, we deem it convenient to dispose of this writ petition by directing Respondent No. 2 to decide application of the Petitioner, copy of which is annexed at Exhibit-C to the petition [page No. 34], as expeditiously as possible and at any rate within the period of eight weeks from the date of receipt of a copy of this order. Ordered accordingly.
4.
It is made clear that we have not gone into merits of the matter and all points and contentions are kept open. 5.
The Petitioner is directed to approach Respondent No. 3 with a copy of this order.
