P.C.:- The learned APP, on instructions from the Investigating Officer, who is personally present in the Court, submitted that the investigation of the present crime is on the verge of completion and the custodial interrogation of the Applicant is not necessary. I have perused the record of investigation. Perusal of record clearly indicates that, as the police at the first instance did not lodge crime, the Respondent No.2 has approached the learned Magistrate and in pursuance of the Order passed under Section 1/2
ssm 2 10-aba1432.17.doc 156(3), the present crime has been registered by the police. It further prima facie, appears that there were various commercial transactions inter-se between the Complainant and the Applicant and when their said relations got soured, the present crime has been registered.
In view of the above, interim relief granted on 10th August, 2017 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
