Mr.Kapadia, learned Counsel for the Petitioner fairly submits that proceedings are already initiated by the Petitioner for appropriate reliefs in the Original Application pending before the Debt Recovery Tribunal, against the persons, who according to the Petitioner, are beneficiaries of the transaction undertaken in breach of the order of interim injunction dated 23 January 2009 passed by the Debt Recovery Tribunal. In this situation, learned Counsel for the Petitioner appropriately seeks leave to withdraw this contempt petition, with liberty to pursue the pending proceedings initiated before the Debt Recovery Tribunal. Accordingly, allowed to be withdrawn, with liberty as prayed for. Dismissed as withdrawn. All contentions of the parties on merits of the matter are expressly kept open.
