Having taken instructions from his client, learned Counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to file representation to Respondent No. 2 for the regularisation of the subject offending structure. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and dismissed as such.

In the event such an application for regularisation is filed by the Petitioner within two weeks from today, Respondent No.2 or its Competent Officer shall decide the same as expeditiously as possible and preferably within the period of six weeks from the date of its filing.

It is made clear that we have not gone into merits of the patilsr 1 / 2

matter and all points and contentions of the respective parties are kept open. Respondent No.2 shall decide such application of the Petitioner independently, on its own merits and in accordance with law.

4.
